ALEC Bill Text

WHEREAS, maintenance of effort requirements contained in federal cost sharing programs, grants and regulatory agreements with [insert state] restrict state legislators’ ability to appropriate state funds and set regulatory policy; and

WHEREAS, limitations and restrictions imposed by federal maintenance of effort requirements restrict state legislators’ ability to act as they believe is in the best interests of the citizens of [insert state]; and

WHEREAS, such limitations and restrictions constitute impingements upon states’ rights set forth in the Tenth Amendment to the U.S. Constitution, and

NOW, THEREFORE BE IT RESOLVED, [insert state] opposes the limitations and restrictions imposed by federal maintenance of effort requirements and calls on Congress to modify maintenance of effort requirements in ways that ensure federal grants and cost sharing funds are spent for the purpose intended but do not otherwise impinge upon [insert state] legislators’ ability to appropriate state funds or set state policy.

Approved by ALEC’s Tax and Fiscal Policy Task Force at the ALEC Annual Meeting on Thursday July 23, 2015 and Friday, July 24, 2015.
