The Affidavit of Mailing Act was adopted by ALEC's Criminal Justice Task Force at the States and Nation Policy Summit on December 14, 2002, approved by the full ALEC Board of Directors in January, 2003. ALEC has attempted to distance itself from this piece of legislation after the launch of ALECexposed.org in 2011, but it has done nothing to get it repealed in the states where it previously pushed for it to be made into law.

Model Legislation
Section 1. {Short Title}
This act shall be known as the Affidavit of Mailing Act
Section 2. {Definitions}
Section 3. {Returned Check Notification}
A merchant may notify a customer about a dishonored check by regular mail, supported by an affidavit of service by mailing to the address printed or written on the check or given by the drawer at the time of issuance of the check or the last known address, notice deemed conclusive three days following the date the affidavit is executed.
Section 4. {Repealer Clause}
Section 5. {Effective Date}
